1. Acceptance of Terms

By accessing or using the bothsidez platform at bothsidez.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and bothsidez ("we," "us," or "our"). By creating an account, clicking "I agree," or otherwise accessing the Service, you confirm that you have read, understood, and accepted these Terms.

bothsidez is an AI-powered talent marketplace that connects job seekers with employers through intelligent, agent-mediated matching. The Service enables:

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

The Service is intended for use within the United States. Users accessing the Service from outside the United States do so at their own risk and are responsible for compliance with local laws.

To access most features of the Service, you must create an account. You agree to:

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used for fraudulent purposes.

5. SMS Communications

By providing your mobile phone number and creating an account, you consent to receive SMS text messages from bothsidez. Message and data rates may apply. Message frequency will vary. Reply STOP to opt out at any time. Reply HELP for help. Carriers are not liable for delayed or undelivered messages.

bothsidez sends SMS messages for the following purposes:

Opt-out: You may opt out of transactional SMS notifications at any time by replying STOP to any message or by disabling SMS notifications in your account settings under Profile → Notifications. Note that verification OTPs are required for account security and cannot be disabled while using phone-based verification.

Opt-in: Transactional notification SMS messages are only sent after you explicitly enable them in your account settings.

You agree not to use the Service to:

7. User Content

You retain ownership of any content you submit to the Service, including resumes, job descriptions, and profile information ("User Content"). By submitting User Content, you grant bothsidez a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of operating and improving the Service.

You represent that you have all rights necessary to submit your User Content and that it does not infringe any third-party intellectual property, privacy, or other rights.

8. Intellectual Property

The bothsidez platform, including its software, design, algorithms, and all content created by bothsidez, is owned by bothsidez and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without explicit written permission.

9. Billing and Payments

Certain features of the Service, including job posting and candidate access for companies, require a paid subscription. By subscribing, you agree to pay all fees in accordance with the pricing displayed at the time of purchase.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time from your account settings. Refunds are handled on a case-by-case basis at our discretion.

Placement fees for permanent hires or contract engagements are invoiced separately and governed by your company's service agreement with bothsidez.

10. Termination

You may terminate your account at any time by contacting us at support@bothsidez.com. Upon termination, your right to use the Service will immediately cease.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, provisions of these Terms that by their nature should survive will remain in effect, including intellectual property, disclaimers, and limitations of liability.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

bothsidez does not guarantee that job seekers will receive employment offers or that companies will find suitable candidates through the Service. Match scores and AI recommendations are provided for informational purposes and do not constitute a guarantee of suitability.

12. Limitation of Liability

To the maximum extent permitted by law, bothsidez shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) one hundred dollars ($100).

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
